Chapter 1 General Provisions
1.1 Purpose & Scope
This Privacy Agreement (hereinafter referred to as the "Agreement") is formulated to standardize the rules of personal data and user content processing, clarify the rights and obligations between Fimor operation party (hereinafter referred to as "We", "Us") and registered/visiting users (hereinafter referred to as "You", "User"). This Agreement covers all services of the Fimor APP, including but not limited to video uploading, cover frame extraction, frame preview, local download and other derivative functions of the application.
1.2 Binding Effect
By clicking to confirm, registering an account, uploading videos, or using any functional module of Fimor, you fully acknowledge that you have read, understood and unconditionally accepted all clauses of this Agreement. If you disagree with any clause of this Agreement, you have no right to continue to access and use our services.
1.3 Legal Compliance Benchmark
We abide by global mainstream data protection regulations including but not limited to the General Data Protection Regulation (GDPR), California Consumer Privacy Act (CCPA) and relevant national network privacy laws, and formulate targeted data processing rules based on the single-core service attribute of video cover frame extraction.
Chapter 2 User Access Qualification Rules
2.1 Age Threshold Regulation
This application is positioned as an adult-oriented tool software. Only natural persons aged 18 or older have the qualification to use all services of Fimor. We do not collect, process or store any information from minors, and we will not actively attract underage groups to use our products.
2.2 User Age Commitment
You hereby warrant that your actual age is over 18 years old when using our services. We reserve the right to suspend or terminate your service access qualification if we verify that you are underage or falsify age information. All losses caused by age violation shall be borne solely by you.
2.3 Special Crowd Reminder
If you use this service on behalf of an enterprise or organization, you shall guarantee that you have the legal authorization of the corresponding organization, and the organization also recognizes the binding force of this Agreement.
Chapter 3 Types & Collection Rules of Acquired Data
We adhere to the minimum necessary collection principle, and only collect data that is indispensable for realizing the core function of video cover frame extraction. We will not actively collect irrelevant personal sensitive information such as user real name, mobile phone number, location information and address book without your explicit authorization.
3.1 User Uploaded Content Data
To complete the cover frame extraction service, we will temporarily obtain the video files you actively upload to the platform, including video streams, audio tracks and original frame images contained in the videos. The above content is only used for one-time frame extraction operation, and will not be used for other extended purposes without your additional consent.
3.2 Generated Service Data
After you initiate the extraction instruction, the cover frame pictures automatically generated by the system based on the uploaded video belong to service generated data. You enjoy the exclusive right to use the generated frames, and we only retain temporary access rights to complete service delivery.
3.3 Passive Collected Technical Data
When you access the APP, we will passively collect anonymous technical data, including device model, APP operation log, service access time, function usage frequency and error report data. All technical data cannot be positioned to a single specific user, and we will not associate it with your personal identity information.
Chapter 4 Data Processing & Usage Specifications
4.1 Legal Basis for Data Processing
We process your uploaded video resources and generated cover frames based on your voluntary authorization and service performance requirements; anonymous technical data is processed based on our legitimate interest in optimizing product functions and troubleshooting.
4.2 Authorized Usage Scope
All collected data is only used for the following scenarios: (1) Execute core commands such as video parsing, cover frame extraction and frame quality optimization; (2) Repair APP operation bugs and solve user feedback problems; (3) Count product function usage data to optimize service experience; (4) Comply with mandatory legal supervision requirements.
4.4 Prohibited Usage Behavior
We promise not to sell, rent, auction or gift your uploaded videos, original cover frames and related user exclusive content to any third-party institution or individual for commercial or non-commercial purposes, unless we obtain your written explicit authorization in advance.
Chapter 5 Data Storage, Encryption & Destruction Mechanism
5.1 Storage Cycle
The video files uploaded by users and the generated cover frame resources are stored in our encrypted cloud server temporarily by default, with a maximum storage period of 7 calendar days. After the expiration of the period, the system will automatically clear the corresponding data without manual operation by our team; you can also manually delete uploaded videos and generated frames at any time through the APP built-in function.
5.2 Data Encryption Protection
We adopt end-to-end AES-256 encryption technology for all user uploaded content during transmission and storage to prevent data leakage, tampering and theft. Anonymous operation logs are stored in isolated independent servers to avoid cross-data access risks.
5.3 Data Destruction Rules
After you manually delete the content or the system automatically clears expired data, we will completely erase the corresponding data from the cloud server and backup database, and cannot recover it. For anonymous technical logs that do not involve user identity, we will regularly clean up invalid data every 30 days.
Chapter 6 Data Sharing & Disclosure Rules
6.1 Restricted Sharing Principle
We will not share your exclusive user content with any third party in any daily scenario. The only allowed sharing scenarios are limited to the statutory special circumstances specified in Article 6.2 of this chapter.
6.2 Statutory Disclosure Scenarios
We may disclose your relevant data to third parties without your prior consent under the following circumstances: (1) Receive formal inquiry, subpoena or administrative penalty decision issued by national judicial organs and regulatory authorities; (2) It is necessary to protect our legitimate rights and interests such as property safety and service security; (3) Emergency scenarios to protect the personal safety of users or the public.
6.3 Third-Party Service Supervision
If we cooperate with third-party cloud storage service providers, we will sign a strict data confidentiality agreement with the partners to restrict the data processing behavior of third parties, and we shall be jointly responsible for data leakage accidents caused by the partners' violations.
Chapter 7 User Rights & Obligations
7.1 User Legal Rights
(1) Access Right: You can query the uploaded video records and generated cover frame records within the storage cycle through the APP;
(2) Deletion Right: You have the right to delete any uploaded video and generated frame data at any time;
(3) Withdrawal Right: You can withdraw the data authorization granted to us at any time; after the withdrawal, you will no longer be able to use our frame extraction service;
(4) Inquiry Right: You can consult us about our specific data collection and processing methods through the official contact email.
7.2 User Usage Obligations
(1) You shall not upload videos involving pornographic, violent, illegal, infringing third-party copyright and other prohibited content to the platform;
(2) You shall independently bear the legal liability for all videos uploaded by yourself, and we are not liable for any legal disputes caused by illegal uploaded content;
(3) You shall not use our services to carry out data crawling, cracking, secondary development and other behaviors that damage the normal operation of the platform.
Chapter 8 Third-Party External Links & Services
Our APP may contain external links of third-party websites or third-party functional plug-ins. This Agreement is only applicable to the independent services provided by Fimor. We have no control over the privacy policies and service rules of third-party platforms, and we do not assume any legal liability for data risks arising from your access to third-party links and services.
Chapter 9 Agreement Revision & Notification Mechanism
9.1 Revision Right
We reserve the right to revise and update this Agreement according to business adjustment, functional iteration and legal policy changes. The revised Agreement will be uniformly updated on the official page of the APP, and the latest update time will be marked at the top of the Agreement.
9.2 User Notification & Confirmation
We will remind users of the Agreement update through APP pop-up notification. Your continued use of our services after the update of the Agreement shall be deemed that you accept the revised clauses officially. If you disagree with the updated content, you shall stop using all services immediately.
Chapter 10 Dispute Resolution & Supplementary Provisions
10.1 Dispute Negotiation
In case of any dispute between you and us arising from the performance of this Agreement, both parties shall first resolve it through friendly email negotiation.
10.2 Jurisdiction & Applicable Law
If the negotiation fails, either party may submit the dispute to the local competent judicial court where the operator is located for settlement. This Agreement shall be interpreted and constrained in accordance with international common data protection laws and relevant regional laws.
10.3 Invalid Clause Exception
If any single clause of this Agreement is deemed invalid or unenforceable due to legal changes, the validity of other remaining clauses shall not be affected in any way.
